Any property owner subject to the levy of a special assessment for the installation of sewer or water line not required to immediately connect to such sewer or water line may participate in the Consensual Lien Program under the following terms and conditions.
(a) Within thirty days of the publishing of the Notice of the Assessing Ordinance the property owner shall either pay the assessment or enter into a consensual lien.
(b) Said consensual lien shall be in form provided by the City of Twinsburg and shall provide that the full amount of the assessment and any connection or tap in fees required by law shall be due and payable upon the occurrence of any of the following:
(1) Connection to the subject improvements;
(2) Sale of the property subject to the consensual lien;
(3) Failure of the septic system in the case of sanitary sewer improvement or failure of the water well in the case of water line improvement.
(c) The consensual lien document shall be recorded with the appropriate Summit County official and shall be in full force as a lien against the subject property until discharged by the City of Twinsburg according to its terms.
(d) Transfer of an interest in property between or among tenants in common shall not be considered as sale of the property for the purposes of paragraph (b)(2) herein.
