1191.09 MODIFICATIONS.
   The Planning Commission may permit modification of the plats and plans required herein subject to final approval by Council where exceptional factors require such modification provided that the Commission shall:
   (a)   Find that strict compliance with these regulations would create an unnecessary hardship and practical difficulty in the face of the exceptional conditions. Financial hardship shall not be considered as a prima facie reason for modification.
   (b)   Permit any modification as recommended by the Engineer to depart from these regulations only to the extent necessary to remove the unnecessary hardship.
   (c)   Find that any modification granted will not be detrimental to the public interest.
   (d)   Require such other conditions to be met by the proposed plat as the Planning Commission may find necessary to accomplish the purposes of these regulations when modified.
