(a) This chapter applies to all WETs proposed to be constructed after the effective date of this section.
(b) All WETs constructed prior to the effective date of this section shall not be required to meet the requirements of this chapter; however, any physical modification to an existing WET that materially alters the size, type, equipment or location shall require a permit under this chapter.
