The fees to be charged by duly licensed haulers of garbage and refuse hereunder shall be as established between the licensed hauler and the customer under precept of democratic, free-enterprise business initiative provided however that:
(a) Council reserves the right to regulate such maximum fees in the future should competitive, free enterprise prove not to be beneficial to residents, and
(b) Council requires duly licensed haulers to assess the same going fee to persons similarly situated within the Municipality so as not to engage in any discriminatory practices that are not related to the variable factors of time of employees expended, volume of garbage or trash to be hauled, distance to be hauled from structure, nature of garbage and/or refuse, etc.
