(a) No operator of a truck, trailer or semitrailer shall operate the same so that there is less than 300 feet between it and any truck, trailer or semitrailer ahead, except when the truck ahead is stopped by a traffic control signal or by a police officer. For the purpose of this section, the words “truck”, “trailer” and “semitrailer” mean every motor vehicle designed and used for the carrying of property wherein the over-all length of such vehicle, including trailer, is in excess of twenty feet, or any truck tractor.

(b) Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
