Whoever violates any of the provisions of this chapter shall be guilty of a misdemeanor of the third degree, the penalty for which shall be a maximum fine of five hundred dollars ($500.00) and imprisonment for a maximum period of sixty days, or both. Each subsequent violation within two years of previously being convicted of or pleading guilty to the same provision of this Code shall be a misdemeanor of the first degree, the penalty for which shall be a maximum fine of one thousand dollars ($1,000.00) and imprisonment for a maximum of six months, or both. Each instance of violation shall constitute a separate offense. In the event the offending party is an organization, as defined in Section 501.11 of the General Offenses Code, both the organization and its president, partners or sole proprietor may be prosecuted for the violations or offenses.
