1323.08 NOTICE REQUIRED; ACKNOWLEDGEMENT BY PURCHASER.
   (a)   No person, partnership, corporation or other entity, having subdivided any real property or having constructed any house or other dwelling unit shall convey any interest in such property, by deed or contract, unless the purchaser has been provided with notice in writing of the existence of any of the conditions set forth in this section.
   (b)   The conditions are as follows:
      (1)   Classification of all or any portion of the subject property as wetland. The prospective buyer shall be notified that such classification may cause special consideration as to fencing, landscaping and future construction.
      (2)   The fact that the property borders on a private drive. The buyer shall be advised that the City will not provide snow removal and solid waste removal on such private drive.
      (3)   The existence of a functioning, municipality operated landfill, or a landfill registered with the E.P.A. within 2,000 feet of the property.
      (4)   The existence of railroad tracks within 2,000 feet of the property.
   (c)   The seller of property subject to this section shall furnish the Building Department with a signed copy of such written notice to the purchaser.
