3)   DEPOSITS
   a)   Construction Deposits
      i)   Upon submittal of a completed non-residential or residential building permit application the following deposit shall be included with the application:

      ii)   Such money shall be deposited as a guarantee that the applicant will repair or replace any damage or destruction to the sidewalk, curb, pavement, and other miscellaneous appurtenances located in the public right-of-way. For the maintenance and cleaning of the roads, catch basins and sewers. Maintenance of the temporary drives, and for the installation and maintenance of on-site erosion control, and proper site grading. The deposit may be used for replacement of topsoil when removed by the builder or developer.
      iii)   Upon the failure of a builder or developer to make corrections as directed by the Building Commissioner, City Engineer, or the Public Works Director, the City may direct such work to be completed. Such costs shall be deducted from the cash deposit. If any deposit shall fall below the required amount, the builder or developer shall make an additional deposit.
      iv)   Six hundred dollars ($600.00) of such (residential) deposit shall be held for two years pursuant to Section 1325.10 of the Codified Ordinances.
   b)   Use of Deposits.
      i)   An order to correct any condition or remove any substance shall be complied with within three days after notice. Upon failure to obey such order, the Building Commissioner shall cause same to be done at the expense of the permit holder and the bond fund shall be subjected to the payment of the expense thereof. If such deposits are insufficient to fully pay for such expense, then the permit holder shall be liable for the additional amount in excess of the bond fund, which coverage shall be collected by the Director of Law in a court of competent jurisdiction.
      ii)   The deposit shall also be subjected to the payment of all unpaid inspection and re-inspection charges as established herein.
   c)   Re-inspection Charge.
      i)   When an inspection is requested and is made, the work is found to be incomplete, faulty or not in conformity with the Building Code, the plans, and/or specifications, a red tag (notification of rejection) will be issued. A charge of fifty dollars ($50.00) shall be assessed against the construction deposit for each red tag issued during construction.
4)   THREE PERCENT ASSESSMENT FOR NONRESIDENTIAL PROPERTIES
   a)   The Building Commissioner is authorized and directed to collect, on behalf of the Board of Building Standards of the state, an amount equal to three percent (3%) of all the various plan review, building permit, and inspection fees as prescribed in the Building Code of the city for nonresidential property. This assessment, as collected on behalf of the Board of Building Standards, shall be in addition to the current fees charged for inspections and for the issuance of various building permits for nonresidential properties.
   b)   The Director of Finance is authorized and directed to remit any assessments received pursuant to division (a) hereof to the Board of Building Standards of the state on a monthly basis.
5)   ONE PERCENT ASSESSMENT
   (a)    The Building Commissioner is authorized and directed to collect, on behalf of the Board of Building Standards of the state, an amount equal to one percent (1%) of all of the various plan review, building permit and inspection fees as related to the new Residential Code of Ohio. This assessment, as collected on behalf of the Board of Building Standards shall be in addition to the current fees charged for plan reviews, inspections and for the issuance of various building permits.
   (b)    The Director of Finance is authorized and directed to remit any assessments received pursuant to division (a) hereof to the Board of Building Standards of the state on a monthly basis.
   (c)    The one percent (1%) assessment as provided for in division (a) hereof shall be collected by the Building Commissioner from and after January 1, 2021.
