903.03 BOND REQUIRED TO ASSURE COMPLIANCE.
   Each person, firm or corporation engaging in subdivision development or any new construction, including garages, accessory or appurtenant structures or remodeling projects, to whom a building permit is issued, shall, at the time of issuance of such permit post cash bond with the City through the office of the Building Commissioner to assure compliance with this chapter according to the following schedule:

   Such cash bond shall be refundable in whole should the adjacent and proximate streets be kept free from nuisance or hazard of accumulations of mud, silt, dirt or debris. Such bond shall be chargeable for action taken by the City in cleaning and maintaining such dedicated or tendered streets after the first notice as such nuisance is directly attributable to the permittee’s construction and inadvertance of his agents, employees or subcontractors or others who shall do work upon such construction project or within such subdivision regardless of their relationship to the permittee. It is understood that the permittee shall be the primary party chargeable with the observance of this chapter. Any unexpected balance of cash deposit shall be refunded to permittee upon issuance of a certificate of occupancy or release of maintenance bond as the case may be. If such deposits are insufficient to fully pay for such expense, then the permittee shall be liable for the additional amount in excess of the deposit, which coverage shall be collected by the Director of Law in a court of competent jurisdiction.
