Upon the granting of a permit to remove topsoil, earth or dirt, the Mayor shall collect a permit fee, to be deposited with the Finance Director, which shall be at the rate of twenty cents per estimated cubic yard of material to be removed or relocated from its natural site to a distant site. Such estimate shall be approved and verified by either the Engineer or the Chief Building or Zoning Inspector, either of whom shall continue to make inspections throughout the course of the permit's operations. The Mayor shall waive such permit fee when he shall first determine that the relocation of such topsoil, dirt or earth shall be beneficial to the health, safety and welfare of the residents of the City. It is determined that the public interest is served when such materials are redeposited upon:
(a) Flood plain lands within the corporate limits so far as to fill and reclaim the same, or
(b) Publicly owned lands within the corporate limits so far as to fill and reclaim the same for the public use and enjoyment.
