Any person, who sells or causes to be sold any goods, wares or merchandise in any building, or any streets or alleys or any other public or private place at public auction to the highest bidder, shall be deemed operating or causing to be operated an auction sale in the City and shall be subject to the provisions of this chapter. The provisions of this chapter shall not apply to any judicial or executive officer offering goods, wares or merchandise for sale at auction by virtue of any judgment or decree of any court or in fulfillment of any law, nor to auctions operated by any charitable organization.
