725.03 BURGLAR AND FIRE ALARMS; POLICE AND FIRE DEPARTMENT RESPONSE.
   (a)   If, after the Police Department responds to more than three false alarms within a twelve month period from an automatic intrusion alarm system at a commercial location, the Police Chief shall give written notice by certified mail to the owner and lessee, if any, of the building in which the system is installed that the City may assess a charge of up to five hundred dollars ($500.00) for each subsequent false alarm within twelve months beginning with the date of the third false alarm and that the City may assess such charges without further notice. If such charge is not paid within sixty days of service of notice of the assessment such charges shall be entered upon the tax list and tax duplicate and shall be a lien upon the property served. As used in this section, "commercial location" means a location used primarily for non-residential, business purposes.
   (b)   If, after the Fire Department responds to a false alarm from an automatic fire alarm system at a commercial location, the chief shall give written notice by certified mail to the owner and lessee, if any, of the building in which the system is installed that the City may assess a charge of up to five hundred dollars ($500.00) for each subsequent false alarm within a period of a rolling twelve month period after any false alarm by that system, and that the City may assess such charges without further notice. If such charge is not paid within sixty days of service of notice of the assessment such charges shall be entered upon the tax list and tax duplicate and shall be a lien upon the property served. As used in this section, "commercial location" means a location used primarily for non-residential, business purposes.
