531.07 PENALTIES.
   (a)   For any act or omission which constitutes a violation of Sections 531.04-531.05, the licensed vendor shall upon conviction, be penalized as follows in addition to any penalty imposed by a Court of Law:
      First violation within five years      $500.00 Fine.
      
      Second violation within five years      $1,000,00 Fine and 90 day suspension of license issued hereunder (including the privilege of selling tobacco products)
      Third and any subsequent violation      $1,000.00 Fine and permanent termination of license issued hereunder.
      
   (b)   If a cigarette and tobacco vendor's license is suspended for any period of time, or terminated, pursuant to this section, the Chief of Police shall forthwith send, by certified mail, return receipt requested, a certified copy of the order of suspension to the vendor, addressed to the vendor at the premises stated in the applications of such license. The vendor, upon receiving such notice of suspension shall forthwith surrender the license to the Chief of Police. The Chief of Police shall retain the license in his/her possession until the termination of the period of suspension, when the license, if not terminated or expired, shall forthwith be returned to the vendor. During the period of suspension, the Chief of Police shall not issue a new license for the vendor's premises. (Ord. 33-2019. Passed 3-19-19.)
