521.09 POLLUTION OF WATERCOURSES AND DITCHES.
   (a)   No person shall throw, deposit or permit to be thrown or deposited, any sewage, waste, refuse or filthy drainage into any lake, pond, stream, ditch, drain or watercourse, or in or on any place from which it may run or wash therein.
 
   (b)   No person shall directly or indirectly cause or permit treated or untreated sewage effluent to flow into or upon any open ditch, swale or drainage course within the corporate limits except that a septic system which has been previously approved by the Summit County Department of Health. The Municipal Engineer may be permitted to discharge treated effluent into a drained course other than a roadside ditch or it may flow into a storm sewer so long as the septic system is properly installed, maintained and functioning so as to treat the discharged effluent in such a manner that the effluent shall not be a hazard to the public health.

   (c)   Whoever violates this section is guilty of a minor misdemeanor.
