(a) No person shall operate, engage or set in motion, heavy construction equipment or machinery such as backhoes, earthmover, cranes, bulldozers, air compressors, power trenches, power loaders, etc., between the hours of sunset and 7:30 a.m., Monday through Friday, and 8:00 a.m., on Saturday, nor shall any such mechanical apparatus be operated on Sunday. Council finds that such apparatus, by its nature and use, creates loud noises and emits fumes of such intense character and duration so as to disturb the peace and quiet of the community and becomes detrimental to the life and health of individuals during such hours and on Sundays.
(b) Whoever violates this section is guilty of a minor misdemeanor.
