(a) Written notice of violation. Any person found to be violating any provision of this chapter’s rules and regulations shall be served by the Approving Authority with a written notice stating the nature of the violation and providing a reasonable time for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations. Any person who shall violate any of the provisions of this chapter or rules or regulations of the village, or who shall connect a lateral without first having obtained a permit therefor, or who shall violate any provisions of the state statutes, Administrative Code, or any other rules or regulations which are incorporated by reference, shall upon conviction thereof forfeit the amount established under § 9-2-6(b)(5) and the costs of prosecution. This, however, shall not bar the village from enforcing the connection duties set out in § 9-2-21 for mandatory connection.
(b) Accidental discharge. Any person found to be responsible for accidentally allowing a deleterious discharge into the sanitary sewer, which causes damage to the wastewater treatment facility, receiving body of water and/or downstream waters shall, in addition to a forfeiture, pay the amount to cover damages, both values to be established by the Approving Authority.
