(A) The purpose of this chapter is to provide a mechanism whereby minor deviations from zoning district regulations can be granted by the Planning and Building Director. A minor deviation may be granted up to 10% of the zoning district regulations and up to 20% for front yard setbacks. The Planning and Building Director shall have the authority to declare what constitutes the front of a lot. Any minor deviation application that exceeds 10% of a district standard shall be processed as a variance consistent with the requirements of Chapter 10.128, Variances.
(B) Minor deviations shall only be granted when practical difficulties, unnecessary hardships and conditions inconsistent with the purpose and objectives of this title may result from the strict application of certain provisions of this title. The granting of a minor deviation and its associated conditions shall not constitute a special privilege inconsistent with the limitations on other properties in the vicinity and in other like zoning districts within the city.
