(a) Purpose and Intent. The purpose of this section is to establish general procedures and standards for underground utilities areas within the City of Troy, Ohio Right-of-Way.
(b) Underground Utility Area. From the effective date of this section, all facilities located in the public right-of-way, except poles, shall be placed underground for those areas identified in the map set forth in Exhibit B, attached hereto and made a part hereof, and maintained by the Director of Public Service and Safety and described as the underground utility area.
(c) Annexed Property. All property annexed into the City of Troy, Ohio after the effective date of this legislation shall be automatically deemed as an underground utility area.
(d) Waiver. In the event of practical difficulties, the Director of Public Service and Safety may grant a waiver for the underground utilities siting requirements.
