935.04 RECEIVING MONEY; CEMETERY FUND.
   (a)    All money received for the sale of lots, opening and closing of graves, and other services about the cemeteries, shall be paid to the Director of Public Service and Safety, or his agent the Superintendent of Cemeteries, who shall give proper receipts therefor. No deed to any cemetery lot shall be issued nor shall any services be performed in or about the cemeteries until a receipt showing payment to the Director, or his agent the Superintendent of Cemeteries, of the cost thereof is exhibited to the person whose duty it is to give such deed or perform such services.
   (b)    All money received from the sale of lots and for the performance of any service in or about the cemeteries shall be placed in the Cemetery Fund, which Fund shall be used for the payment of the purchase price of grounds, or for the maintenance and improvement, and for no other purpose whatsoever. The City Auditor shall keep an account of all receipts and disbursements of money belonging to the Cemetery Fund and shall pay money out of such Fund only on orders signed by the Director of Public Service and Safety and countersigned by the Auditor, which orders shall specify that the money shall be paid from the Cemetery Fund.

   (c)    The Director of Public Service and Safety is hereby authorized under Ohio R.C. 759.12 to accept and receive, by agreement, gift, devise, bequest or otherwise, money to provide a perpetual care fund of the cemetery, which shall be handled and invested by the City Auditor in an account called the Cemetery Trust Fund as provided in Ohio R. C. 759.15, and the income of which fund shall be applied by the Director to the perpetual care of the lot or lots as agreed upon by the Director. No sum shall be received by the Director of less than one thousand dollars ($1,000) for the perpetual care of the lot or lots specified in the agreement or as provided for in the rules adopted by the Director.

   (d)    There is hereby established a Cemetery Endowment Fund, which will be funded by twenty-five percent (25%) of the sale of all cemetery lots and crypts in the City cemeteries, which Fund shall be used in the future to offset a portion of the operational and maintenance costs of the City cemeteries.
