For the purposes of this chapter, the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future tense, words in the plural shall include the singular, and words in the singular include the plural, "Shall" is mandatory and not merely directory.
(a) “Arboriculture Specifications and Standards of Practice” means the regulations which governs the selection for planting, maintenance, protection and removal of public trees.
(b) "City" means the City of Troy, a municipal corporation of the State of Ohio.
(c) "City Forester" means the designated official of the City assigned to carry out the execution of this chapter.
(d) "Drip-line" means the approximate vertical extension to the ground of the outermost branches and leaves of a tree as an indication of the spread of the root system.
(e) “Monarch Tree” means a tree determined to be of historical interest, high aesthetic value, or of unique character due to species, type, location, age, or size as designated by the Park Board.
(f) "Park" includes all real property owned by the City and/or Board of Park Commissioners and not used for governmental functions.
(g) "Park Board" means the Board of Park Commissioners of Troy, Ohio.
(h) "Person" means any person, firm, partnership, association, corporation, company or organization of any kind, public or private.
(i) "Property line'' means the outer edge of a street or highway easement.
(j) "Property owner" means the person owning such property as shown by the records of the County Auditor of Miami County, Ohio.
(k) "Public places" includes all grounds owned by or under the control of the City or Park Board.
(l) "Public trees" includes all shade and ornamental trees now and hereafter growing within the Tree-lawn or any public place,
(m) "Shade or ornamental tree or shrub" means any and all woody vegetation.
(n) "Street or highway" means the entire width of every public way, easement, or right of way when any part thereof is open to the use of the public, as a matter of right, for purposes of vehicular and pedestrian traffic, and includes alleys.
(o) “Tree Board” means the City Beautification Committee of Troy, Ohio.
(p) "Tree-lawn" is that part of a street or highway right-of-way, not covered by sidewalk or other paving material between the property line and the area between the sidewalk and curb.
(q) "Tree work" means any planting, maintenance, protection, or removal of trees.
