(a) The City and the grantee shall hold scheduled performance evaluation sessions within thirty days of the fifth and tenth anniversary dates of the grant of the franchise. All such sessions shall be open to the public and announced in a newspaper of general circulation at least five days before each session.
(b) Special evaluation sessions may be held at any time during the term of the franchise, provided that both the City and the grantee shall mutually agree on the time, the place and the topics to be discussed. All such evaluation sessions shall be open to the public and announced in a newspaper of general circulation at least five days before each session.
(c) The following topics shall be discussed at every scheduled evaluation session: Service rate structures; free or discounted services; application of new technologies, system performance, services provided; programming offered; customer complaints; privacy; amendments to this chapter; and judicial and FCC rulings.
(d) Topics in addition to those listed may be added if agreed upon by both parties. Members of the general public may add topics either by working through the parties or by presenting a petition. If such a petition bears the valid signatures of fifty or more qualified electors of the City, the proposed topic or topics shall be added to the list of topics to be discussed at the evaluation session.
