1341.16 RIGHT TO APPEAL; APPEALS BOARD.
   (a)   Petition. Any person affected by any notice which has been issued in connection with the enforcement of any provision of this Code, or of any rule or regulation adopted pursuant thereto, may request and shall be granted a hearing on the matter before the Property Maintenance Appeals Board provided that such person shall file in the City Offices a written petition requesting such hearing and containing a statement of the grounds therefor within fifteen days after the day the notice was served.
   (b)   Appeals Board. In order to protect existing structures in the jurisdiction by vigorous enforcement of the provisions of this Code, there shall be and is hereby created a Property Maintenance Appeals Board.
   (c)   Board Membership. The Board shall consist of five Trotwood residents who are qualified electors of the City. Board Members shall be appointed by Council, to serve without compensation, for staggered terms of five years. Board Members appointed by Council on or before December 1, 2021 shall continue their appointments for the remainder of their modified terms, unless any such Board Member resigns from the Board. Council shall have the right to remove any Commission or Board Member for cause in accordance with Section 7-1 of the City Charter and to fill vacancies by majority vote. Board Members shall, by majority vote, elect a Chairman and Vice-Chairman.
   (d)   Secretary of the Board. The City's Planning and Development Director, or a duly authorized agent of the Planning and Development Director in the Planning and Development Director's absence, shall serve as secretary to the Board.
   (e)   Vote. The Board shall hear all appeals relative to the enforcement of this Code, and by a vote of the majority of its members may reverse or affirm, wholly or partly, or may modify the decision appealed from, and shall make such order or determination as in its opinion ought to be made. A tie vote shall be deemed a denial and may be appealed to Council.
   (f)   Financial Interest. A member of the Board shall not participate in any hearings or vote on any appeal in which he has a direct or indirect financial interest, or is engaged as a contractor, or is engaged in the preparation of plans and specifications, or in which he has any personal interest.
   (g)   Records. The Secretary of the Board shall keep a record of each meeting so that the record shows clearly the basis for each decision made by the Board.
