205.03 SERVICE DEPARTMENT FEES.
   (a)   Water.
      (1)   Appropriate ERU (Equivalent Residential Unit) classifications and additional costs are to be determined by the Service Director under the supervision of the City Manager.
         A.   One ERU is defined as the average water capacity requirements for a detached single-family dwelling. All uses other than single-family dwellings shall be expressed in fractions or multiples of one ERU, utilizing the table of ERUs for typical uses as it appears in Table 205.03-1 as a guideline.
      (2)   At the time of application for a building permit for a structure requiring water service, or at the time of application for water service, whichever occurs first, a water system connection fee shall be collected from the applicant in accordance with Section 205.03(a)(3).
      (3)   Water system connection fees shall be computed on the basis of ERU(s) plus costs incurred by the City as a result of the connection.
      (4)   The water system connection fee shall be regulated by Section 205.03(a)(5), plus the most current cost of the required meter fittings, corporation stop, appurtenances thereto, and any costs incurred by the City for materials or labor pertaining to the installation, inspection or tapping involved.
      (5)   Water system connection fees per ERU: $4,000.00.
   (b)   Sewer.
      (1)   Appropriate ERU (Equivalent Residential Units) classifications shall be determined by the Public Services Director and the City Manager or by the City Engineer in accordance with such table and the Ohio Department of Health Sewage Flow Guide.
      (2)   All residences, businesses, industries, structures or uses shall pay a sewer connection fee according to Section 205.03(b)(6). There shall be collected from each applicant for a building permit at the time of application a sewer connection fee for each residence, business, industry, structure or use according to Section 205.03(b)(6). No construction shall be approved without the payment of such sewer connection fees.
      (3)   Sewer connection fees shall be computed on the basis of ERU(s). One ERU is hereby defined as the average sewage flow capacity expected from a typical detached single- family dwelling. All uses other than single-family dwellings shall be expressed in fractions or multiples of one ERU as follows:

         A.   Intermediate classifications can be established at any multiple of 12,000 gallons/month with 1 ERU charged per 12,000 gallons/month maximum base rate usage.
         B.   Peak use surcharges shall be applied to all wastewater discharge in excess of the established maximum monthly use. Charges for volumes of commercial or industrial wastewater are subject to 150% and 200% peaking charges, times the base rate for commercial and industrial customers, as provided for by the Butler County ERU Program.
         C.   Customers can be reclassified to a higher maximum monthly use classification to avoid peak use surcharges by paying the additional connection fees applicable to the higher classification less credit for the fees previously paid.
      (4)   The use or change of any use of any residence, business, industry or structure for or to any purpose producing a greater burden on the capacity of the City's sewerage system than the use for which a sewer connection fee has been levied shall be cause for the imposition of an additional sewer connection fee based upon the new ERU factor or multiple according to the sewer connection fee in Section 205.03(2)(f), minus any previously paid sewer connection fees.
      (5)   Any person responsible for the payment of a sewer connection fee under this section may enter into a contract with the City for payment by installments over a five-year period of the sewer connection fee or unpaid portion thereof. The faithful performance by the person responsible for the payment of the sewer connection fee under the contract shall be secured by a mortgage on the real estate   for which the sewer connection permit is issued, with the City as mortgagee, which need not be a first lien on the real estate. Such deferred sewer connection charges shall bear a fixed rate of interest on the unpaid balance, based on the Prime Lending Rate as established by the United States Federal Reserve (Federal Open Market Committee, FOMC). The cost of recording the mortgage shall be paid by the mortgagor.
      (6)   Sewer Connection fees per ERU: $800.00.
