(a) When a property has been determined to be a chronic nuisance property under Section 1802.03
, a notification for payment of the prescribed civil penalty (the "violation notice") shall be issued in writing to the owner(s) of the property. This violation notice shall, at a minimum, be sent by certified mail to the tax mailing address(s) on record at the Butler County Auditor's Office and shall contain the following:
(1) The name(s) of the owner(s) of the property as listed with the Butler County Auditor's Office;
(2) The address and parcel number of the property in violation;
(4) A copy of the section of the City Code that was repeatedly violated causing the property to be designated as a chronic nuisance property;
(5) The date of each violation of the City Code or Ohio Revised Code that was repeatedly violated, causing the property to be designated as a chronic nuisance property;
(6) A statement of the amount of the civil penalty due to the City of Trenton under subsection (b) hereof, stipulating that the amount must be paid in full to the City's Department of Finance within thirty days after the date of the violation notice;
(7) A prominent notice that failure to pay the civil penalty within thirty days of the date of the violation notice will result in the penalty amount, with statutory interest, to be certified to Butler County Auditor's Office for collection with the real estate taxes;
(8) The date by which the owner is required to abate the violation to prevent another civil penalty from being assessed as provided by Section 1802.06, Abatement; and
(9) A prominent notice that subsequent violations of the same City Code on the same property may result in additional civil penalties as provided by subsection (b) hereof.
(b) Schedule of civil penalties under this chapter, which are in addition to any other fines or penalties allowed by law for the same offence.
(1) First violation of this chapter - fifty dollars ($50.00).
(2) Second violation of this chapter - additional one hundred dollars ($100.00) within 365 days after the first violation of this chapter.
(3) Third violation of this chapter - additional two hundred fifty dollars ($250.00) within 365 days after the second violation of this chapter.
(4) Fourth violation and all subsequent violations of this chapter - additional five hundred dollars ($500.00).
(5) After one year without a repeat violation of this chapter, the property shall no longer be designated a chronic nuisance property, but instead shall be treated as if it had not been previously designated as such.
