§ 151.31 DESIGN AND CONSTRUCTION REQUIREMENTS.
   In addition to such requirements as may be reasonably imposed by the Board of Health, the Code Enforcement Officer shall not issue any permit as required by this chapter unless the following design and construction requirements are to be observed in such work, and all pools shall be constructed and maintained in conformity with the following requirements.
   (A)   Material. The material used for lining pools shall be one which is light in color, is impervious and will provide a tank with smooth and easily cleaned surfaces. Sand or dirt bottoms are prohibited.
   (B)   Walls. The side walls shall be vertical to a depth of at least five feet. However, a slope is permitted which shall not be more than one foot horizontal and five feet vertical to a depth of five feet from the top.
   (C)   Steps or ladders. At least one means of egress in the form of steps or ladders shall be provided for all private residence swimming pools. Treads of steps or ladders shall be constructed of non-slip material at least two and one-half inches wide for their full length. Steps or ladders shall be equipped with a handrail.
   (D)   Walk area.
      (1)   There shall be an unobstructed walk area not less than 36 inches wide to extend entirely around the pool. It is recommended, but not required, that the walk area shall be constructed of impervious material and the surfaces shall be smooth and easily cleaned and of non-slip construction. The slope of the paved walk shall have a pitch of at least one-fourth inch per foot, designed to prevent back drainage from entering the pool.
      (2)   Where an impervious walk area as described under division (D)(1) above is not installed, then the slope away from the edge of the pool shall be at least one inch per foot for distance of not less than three feet.
   (E)   Fences. A fence or wall shall be installed and maintained so as to completely surround the pool. Such fence or wall shall be an effective barrier to small children, and shall be at least 48 inches in height. Gates thereof shall be self-closing and shall be equipped with self-latching devices placed at the top thereof. Such gate shall be locked when the premises are not occupied or the pool not in use, particularly at night.
   (F)   Aboveground pools; fences.
      (1)   Pools constructed aboveground may be protected from entry by a barrier attached to the pool walls such that the total height of the wall and additional barrier is not less than four feet in height surrounding the swimming pool.
         (a)   Adjacent buildings and decks connected to the barrier can be used to provide protection if the barrier is continuous.
         (b)   Steps or ladders can be used to access the pool, but they must be removed or made inaccessible when the pool is not being used under the supervision of the owner or lawful adult occupant of the premises.
         (c)   No additional yard fencing is required if the four-foot barrier is maintained.
      (2)   Fencing that encloses the entire premises of a residential property on which a swimming pool is located may serve as sufficient fencing for the pool upon inspection and approval of the Village Code Enforcement Officer.
