For the purpose of this chapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.
SWIMMING POOL. Any swimming pool or wading pool over 24 inches in depth, or with a surface area exceeding 250 square feet, at a private residence, intended only for the use by the individual owner, his or her family and friends invited to use same without payment of any fee. This includes, but is not limited to, portable or temporary pools of plastic, rubberized cloth or similar materials installed either above or below ground elevation. However, this chapter shall not apply to public swimming pools, their equipment and operation, which comply with the Minimum Sanitary Requirements for Swimming Pools of the state’s Department of Public Health.
