7-4-4: EMERGENCY DISTURBANCES:
Emergency disturbances, cuts and trenches may be made to streets without prior permit if the disturbance, cut or trench is reasonably calculated to prevent loss of life or damage to property which appears to be imminent if the action is delayed by waiting to secure permits for such excavations or encroachments. In such emergency situations, the person making the excavation or encroachment must contact the city immediately and contact must be made with the city building department within two (2) business days after the emergency in order to secure an encroachment permit and any other permits required by applicable law, regulation, ordinance or rule. Emergency situations and conditions do not negate or limit a party's obligation to comply with, and abide by, applicable laws, regulations, ordinances and rules, except for the requirement to obtain proper permits before commencing excavation or encroachment. The party making an emergency disturbance, cut or trench to a street will be liable for all costs incurred by the city for returning the impacted street to its prior condition.
