7-4-3: EXIGENT CONDITIONS:
Exigent conditions may exist when a project is proposed which would impact a street which is subject to the two (2) year moratorium and appropriate planning could not have foreseen the necessity to encroach on the street's surface. The determination to declare a condition as exigent is in the sole discretion of the city council. Prior to making an exigent encroachment, the party requesting to do so must obtain all licenses and permits required by applicable laws, regulations, ordinances and rules for disturbing, cutting or trenching the street and pay all applicable fees.
