§ 72.03 AUTHORITY TO REMOVE AND IMPOUND.
   Whenever any vehicle shall be found wrecked, abandoned or parked on the streets, highways or public property of the borough in violation of any borough ordinance or the Vehicle Code of the commonwealth, now or hereafter in force, or shall be seized by due process of law, such vehicle shall be removed by towing, upon the authorization of the designated official, to an official vehicle pound; provided, however, that no vehicle shall be towed away from the place where it is found, if at the time of the intended removal the owner or person for the time being in charge thereof, is present and shall express a willingness and intention to immediately remove the vehicle, provided that the vehicle has not been loaded onto the towing vehicle. In the event that the vehicle is parked or stalled along a designated snow emergency route during a declared snow emergency; is stopped, parked or stalled on a borough street in a manner as to be obstructing traffic or creating any hazard to public health, safety or welfare; or if a vehicle is parked in an area designated by signs as a no parking zone, reasonable attempts shall be made to notify the owner of the vehicle to remove it, but if the owner cannot be reached, fails or refuses to immediately remove the vehicle, or if the vehicle presents a danger due to its condition or location, the vehicle may be towed and impounded immediately, without notice or further notice, at the cost and expense of the owner, as set forth in § 72.05.
