(A) (1) No horses or other large animals shall be permitted within portions of the town, which have previously been subdivided into lots that do not contain at least two acres of designated pasture.
(2) The pasture necessary to maintain a horse in the town shall be two acres’ minimum of designated pasture for no more than two horses. For each additional horse, there will need to be an additional one acre of designated pasture. Designated pasture shall not include lawns, other areas adjacent to the living quarters or structures. Pasture areas and horses shall be maintained so that any smells shall not leave the site and effluent shall be kept clean from said site and not permitted to leave said site during rainstorms or other times, nor be stored anywhere near or upon the pasture lines. It is intended that the responsible homeowner shall maintain said horse and pasture in a way that is not inconsistent with town living, nor creating a hazard or nuisance for any neighbor.
(B) (1) An individual shall file with the town a petition in writing requesting that he or she be permitted horses and/or large animals, pursuant to division (A) above.
(2) Said written request shall include a drawing, which shall clearly delineate the designated pasture area, which shall be at least two acres and comply fully with all requirements of this division (B), including any area for which waste shall be accumulated and any shelters.
(3) Following the filing of said petition and drawing, the Town Manager shall inspect said property to ascertain compliance with division (A) above, specifically ascertaining the existence of a designated pasture, and shall report to the Town Council his or her findings and recommendations.
(4) Following the report to the Town Council, the Town Council shall make a determination, said determination shall be reduced to writing, and shall be forwarded to the county’s Plan Commission for use at the Topeka-Wolcottville BZA hearing. The letter issued by the Town Board as concerns said pasture shall be a recommendation to said BZA and reference division (A)’s requirements.
