One-way traffic signs shall be erected at the intersection of School Street extended and along Playground Alley, and that all motorists shall be obligated to operate their motor vehicles, in compliance with same, viz: one-way traffic north bound, between School Street extended and South Alley for the entire length of Playground Alley.

No parking signs shall be erected and no parking shall be allowed and all motorists shall be obligated to operate their motor vehicles in such a manner so as not to violate same, viz: on both sides of Playground Alley, between School Street extended and South Alley.

The current motor vehicle registration of any offending vehicle shall constitute prima facie proof that such person was in control of the motor vehicle at the time of such violation; however, said registered owner shall have the right to rebut said presumption by proving that said use at the time and place was unauthorized by him or her.

The town shall have the right to direct the Town Marshal or any other agents to remove and tow away, or have removed or towed away, by any commercial towing service, any motor vehicle illegally parked upon or along either side of Playground Alley. Any vehicles so towed away for illegal parking shall be stored in a safe place and restored to the owner or operator of same upon payment of a commercial towing service bill and the presentation or proper proof of ownership.

(A) Any person, firm or corporation violating any of the aforesaid provisions of this chapter or failing to obey any of the signs described above erected pursuant to same or to otherwise violate any of the portions hereof shall be treated in accordance with this traffic code previously enacted by the Town Council.

(B) The second admission or judgment of a violation of this chapter within a calendar year shall be subject to double the penalty set forth above as the total civil penalty. Any third admission or judgment of a violation of the same ordinance or code provision within a calendar year shall be subject to triple the penalty set forth above as the total civil penalty.

(A) Any owner or operator of a vehicle violating the provisions of § 74.02 of this chapter commits a Class C infraction and shall, upon conviction thereof, be fined in an amount not to exceed $50, plus any and all attorney’s fees and costs of collection.

(B) Any person who violates the provisions of § 74.03 of this chapter commits a Class C infraction and shall, upon conviction thereof, be fined in an amount not to exceed $50, plus any and all attorney’s fees and costs of collection.
