(A) In order for a person to receive and maintain an emergency wrecker service license, he must comply with the following minimum requirements.
(1) Wrecker equipment.
(a) Each wrecker shall be not less than one ton in size and be equipped with booster brakes.
(b) Each wrecker shall be equipped with a power operated winch, winch line, and boom, with a factory rated lifting capacity, or a city tested capacity of not less than 8,000 pounds, single-line capacity.
(c) Each wrecker shall carry as standard equipment tow bar, towing dollies, safety chains, a fire extinguisher, wrecker bar, broom, shovel and flares, and be equipped with amber or yellow lights on top.
(d) Each wrecker and all of its equipment shall be in a safe and good working condition.
(e) Each wrecker shall be equipped with a two-way radio on the frequency allocated to wrecker operators, on channel 260 or 180 only.
(f) Each heavy duty wrecker must comply with the preceding requirements, except; each heavy duty wrecker must not be less than two and one-half tons in size; and each heavy duty wrecker shall be equipped with a power operated winch, winch line and boom, with a factory rated lifting capacity, or a city-tested capacity, of not less than 32,000 pounds, single or double line capacity.
(2) Radios. Each applicant shall maintain radio contact with the Police Department.
(3) Insurance.
(a) Each emergency wrecker company shall maintain public liability and property damage insurance policy with the city designated as a named insured, and the coverage provision insuring the public from loss or damage that may arise to any person or property arising out of the operations of the wrecker service by the emergency wrecker company.
(b) The minimum limits of each liability insurance policy are as follows.
1. For damages arising out of bodily injury to or death of one person in any one accident: $50,000.
2. For damages arising out of bodily injury to or death of two or more persons in any one accident: $100,000.
3. For injury to or destruction of property in any one accident: $50,000.
4. A minimum of $10,000 cargo insurance.
(c) Wrecker service by certification shall hold the city harmless from the liability for any act or omission of such operator or any employees and shall provide liability coverage to guarantee the ability to accomplish same.
(d) Each insurance policy must contain an endorsement providing for 30 days prior to any changes, such as cancellation of insurance and changes in the policy. The insurance company must notify the Chief of Police in writing, 30 days prior to any changes or cancellation of insurance.
(4) Procedure. Each licensee shall adopt the following emergency wrecker service procedures:
(a) Maintain 24-hour wrecker sendee;
(b) Arrive at the accident within a reasonable time after having been notified to do so by the Chief of Police, such response time generally not to exceed 15 minutes;
(c) Deliver, in every instance, the wrecked or disabled vehicle to a location designated by the Chief of Police; or location designated by the owner; and
(d) Report to the Chief of Police all changes in emergency wreckers and equipment used in the licensee’s emergency wrecker service and render all additional vehicles for inspection by the Chief of Police.
(B) A person who maintains a current emergency wrecker service and has a current license shall be entitled to be included on a rotation list maintained by the Chief of Police. The priority for each emergency wrecker company on this rotation list will be based on bids pursuant to this section. The emergency wrecker company giving the lowest bid will receive priority over other emergency wrecker companies.
(C) Whenever the Chief of Police determines that emergency road service is required, the Chief of Police shall contact an emergency wrecker company from the rotation.
