For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ACCIDENT. Any occurrence which renders a vehicle wrecked or disabled.
CHIEF OF POLICE. The head of the City Police Department, or his or her authorized representatives.
CITY. The City of Tool, Texas.
CITY POUND. The storage area designated by the city for wrecked or disabled vehicles.
DISABLED VEHICLE. A vehicle which:
(1) Has been rendered unsafe to be driven as the result of some occurrence other than a wrecker; or
(2) Is in a safe driving condition, but the owner is not present, able or permitted to drive.
EMERGENCY WRECKER COMPANY. A person who renders or desires to render wrecker service.
EMERGENCY WRECKER SERVICE. The business of towing, removing or storing wrecked or disabled vehicles upon request of the Chief of Police.
LICENSEE. A person licensed to engage in emergency wrecker service.
OWNER. A person who holds legal title to a vehicle, or who has legal right of possession or control of a vehicle.
PERSON. An individual, assumed name, entity, partnership, joint venture, association, corporation or other legal entity.
STREET. Any street, alley, avenue, lane, square or highway within the corporate limits of the city.
VEHICLE. A vehicle as defined in Tex. Transportation Code § 541.201(23).
WRECKED VEHICLE. A vehicle which has been damaged as the result of overturning or colliding with another vehicle or object.
WRECKER. A vehicle designed to be used primarily for removing wrecked or disabled vehicles.
WRECKER SERVICE. The business of towing, removing or storing wrecked or disabled vehicles from the streets.
