§ 36.030 DUES, FAIR SHARE, INDEMNIFICATION.
   (A)   Dues checkoff. It is understood and agreed between the village and the union that the village will deduct on the first payday of each month any initiation fees, dues, or assessments upon properly executed check off authorizations for such deductions. Such authorization shall be furnished by the union. Such deductions shall be paid by the twentieth of the current month to Teamsters Local Union No. 26.
   (B)   Fair share.
      (1)   All bargaining unit employees who are not members of the union and who do not become members of the union shall pay to the union each month their fair share of the costs of services rendered by the union each which are chargeable to non-members under applicable law, as certified by the union to the village, and which may not exceed the monthly dues and initiation fees uniformly required of members of the union.
      (2)   The village shall deduct monthly and remit to the union by the twentieth day of the current month of the deduction the required fair share contribution from the pay of any employee.
   (C)   Indemnification. The union shall indemnify and hold the village harmless against any and all claims, demands, suits, or other forms of liability, including costs and attorney’s fees that may arise out of or by reason of any action taken by the village for the purpose of complying with any provisions of this chapter. If an incorrect deduction is made, the union shall refund such amount directly to the involved employee.
