Any person who, by himself or by his servant or agent or as the servant or agent of another person, performs any one of the acts enumerated in this chapter is guilty of a misdemeanor of the second degree for the first offense and upon a second or subsequent conviction thereof shall be guilty of a misdemeanor of the first degree.
