(a) The first permittee licensed under this chapter to provide cable television service shall provide an institutional network ("I-NET") connecting schools, post-secondary institutions, occupational centers, museums, science centers, government offices, corporations and public television ("institutional members") in a broadband, fiber-optic based network capable of providing voice, data and video transmission.
(b) After the City has received an I-NET from the first permittee licensed under this chapter, the City shall require additional institutional networks from subsequent providers or charge such providers a fee per subscriber equal to the per subscriber cost incurred by the I-NET provider. The fee shall be determined at the time the I-NET services are provided and shall be adjusted annually by the City to reflect the cost of I-NET services. The City may reduce the amount paid by the I-NET providers as a result of requiring other cable television providers to pay an amount to the City in support of I-NET service.
(c) The I-NET provider shall own and maintain the I-NET. The I-NET shall be for the use of the users only and no portion thereof shall be used by any other person or entity at any time. The I-NET shall be used only for non-commercial educational and governmental purposes and for public access channels.
