2101.49 Provisional Appointments and Seniority - Classi fied Employees.
   Appointees shall not be appointed to positions unless they are from the appropriate certified list and shall be in the position on the eligibility lists as to qualify for appointment, except in the absence of an eligibility list a Provisional Appointment may be made. The candidate determined by the Appointing Authority to be most qualified for the position from among those meeting the minimum requirements should be appointed. Positions may be filled on a promotional or recruitment basis at the discretion of the Appointing Authority. When a promotional basis is used, the promotion need not be from the next lower classification in the unit, division, or department, but a preference may be made on that basis.
   If no eligibility list is established within one year after the employee is provisionally appointed under this process, then the employee shall be made permanent. Alternate time served continuously up to the time of provisional appointment shall be counted toward the one year period. When a provisional employee is finally certified to the position, the employee's accrued seniority for the duration of the time spent as a provisional employee shall be counted as the employee's seniority date.
   This section shall have no application to Police Deputy Chiefs or Fire Deputy Chiefs appointed on a pro-tem basis.
