1761.02. Permits.
   (a)   No person shall operate a rooming house unless he holds a valid rooming house permit issued by the City Department of Health and Environment in the name of the operator and for the specific dwelling or dwelling unit. The operator shall apply to the City Department of Health and Environment upon compliance by the operator with the applicable provisions of this Housing Code and of any rules and regulations adopted pursuant thereto. This permit shall be displayed in a conspicuous place within the rooming house at all times. No such permit shall be transferable. Every person holding such permit shall give notice in writing to the Toledo Department of Health and Environment within twenty-four hours after having sold, transferred, given away or otherwise disposed of ownership of, interest in or control of any rooming house. Such notice shall include the name and address of the person succeeding to the ownership or control of such rooming house. Every rooming house permit shall expire on March 31 of each year following its date of issuance, unless sooner suspended or revoked as hereinafter provided.
   (b)   Any person whose application for a permit to operate a rooming house has been denied may within fourteen days request in writing and shall be granted a hearing on the matter before the Hearing Officer as set forth in Section 1743.05.
   (c)   Any person applying at the City Department of Health and Environment for a rooming house permit shall have attached to the application a certificate of zoning compliance in accordance with the provisions of applicable zoning laws. The rooming house permit shall state the maximum number of persons who may occupy the rooming house. No rooming house permit shall be issued to any operator which would authorize occupancy of the rooming house by a larger number of persons than is authorized by Section 1745.14 (b). Floor space area for any dwelling unit within the rooming house shall meet the requirements of Section 1745.14.

   (d)   No person shall write or cause to be written, in any rooming house register, any other or different name than the true name of such person or the name by which such person is generally known.

   (e)   No operating permit shall be issued or renewed unless the completed application form is accompanied by payment of a permit fee, as established by rule or regulation of the Director of Health and Environment.
   (f)   No operating permit shall be issued or renewed for an applicant who is nonresident of the City unless such applicant designates to the City Department of Health and Environment, in writing, his agent for the receipt of service of notice of violations of the provisions of this Housing Code and for service of process pursuant to this Housing Code.

   (g)   No operating permit shall be issued or renewed for an applicant who is a resident of the City unless such applicant has first designated an agent for the receipt of service of violations of the provisions of this Housing Code and for service of process pursuant to this Housing Code when such applicant is absent from the City for thirty or more days. Such a designation shall be made in writing and shall accompany each application form. The applicant may designate any person residing in the City his agent for this purpose.
   (h)   An application for renewal of an operating permit must be made within sixty days prior to the expiration of the present operating permit. If the application is not made prior to the expiration of the present permit, no permit shall be renewed without payment of a penalty equal to twice the permit fee.

   (i)   Any person interested in applying for a rooming house permit shall indicate his intent by obtaining a prepared form from the City Department of Health and Environment. Upon receipt of the completed form and the certificate of zoning compliance from the Division of Inspection, the City Department of Health and Environment shall inspect the premises designated on the form to determine compliance with this Housing Code. No fee shall be charged for this inspection. If the property is not in Code compliance, a housing violation notice shall be issued and enforced to achieve compliance.
   When the City Department of Health and Environment determines that the property complies with this Housing Code, the person who indicated his intent to apply for a rooming house permit will be supplied with an application form.
   Any person applying at the City Department of Health and Environment for a rooming house permit shall, at the time of such application, tender a fee which shall be nonrefundable and based upon the following formula:
   Five dollars ($5.00) for each suite of rooms and for each sleeping room.
   Payment shall only be in the form of certified check, cashier's check, postal note or bank draft, payable to: City of Toledo.
   All applications shall be made at the office of the Department of Health and Environment for the City.
   No fee shall be charged for a unit occupied by the owner thereof.
   This regulation shall not apply to hotels, motels and other places of public accommodation licensed by the State pursuant to Ohio R.C. 3731.01.
