1737.09. Approval from Fire Prevention Bureau; compliance denial; appeal.
   (a)   The Commissioner of Health shall not issue a temporary, provisional or regular license to a residential home for the elderly until the home is inspected and approved as in compliance with fire safety standards by the Fire Prevention Bureau.
   (b)   A licensee or applicant who is disapproved and determined to be not in compliance upon inspection by the Fire Prevention Bureau may appeal within seven days to the Fire Prevention Board of Appeal pursuant to the procedure set forth in Section 1511.03, F-104.l.
   (c)   An appeal pursuant to this section does not act to stay compliance with the provisions of this section.
