Any person or entity that constructs, operates, uses, maintains or modifies a swimming pool within the City of Toledo and fails or refuses to comply with or abide by Revised Code Chapter 3749, Ohio Administrative Code Chapter 3701-31, a public health order issued by the Toledo Health Director, or his/her designated representative, or any provision of this chapter is guilty of a misdemeanor of the first degree. Each and every day the violation or noncompliance is found to exist shall be a separate offense.
