(a) Every frozen dessert manufacturer or distributor who prepares, sells, prepares for sale, offers for sale, exposes for sale, disposes of, exchanges or delivers or with the intent so to do, as aforesaid, has in his possession, care, custody or control within the limits of the City of Toledo any frozen dessert, ice cream, frozen custard, milk sherbet, ice or ice sherbet, or any mix for manufacturing any of these products, shall be and remain, at all times, in compliance with Revised Code Chapter 3717 and, specifically, Revised Code Sections 3717.51 through 3717.55.
(b) Any person or entity that engages in or holds himself out to be a frozen dessert manufacturer or distributor shall comply with any order issued by the Toledo Director of Health, or his/her designated representative, pursuant to this chapter and/or Revised Code 3717 et seq.
