§ 75.20 OVERWEIGHT VEHICLES.
   (A)   (1)   Except as specifically allowed by statute or other ordinance, it is unlawful to operate on any highway within the Village a motor vehicle with a weight, including load, that exceeds the limits described in § 15-111 of the Illinois Motor Vehicle Code (ILCS Ch. 625, Act 5, § 15-111). The weight limitations and formulae contained in § 15-111 of the Illinois Motor Vehicle Code are hereby incorporated by reference for purposes of calculating permissible weights under this section.
   (A)   (2)   Except as specifically allowed by statute or other ordinance, it is unlawful for any person to drive or move, or for an owner to knowingly permit to be driven or moved upon any street or highway within the jurisdiction of the village, any vehicle or combination of motor vehicles and load where the required registration fees and taxes for the gross weight of the vehicle and load have not been paid or the vehicle and load exceed the registered gross weight for which the required fees and taxes have been paid by 2001 pounds or more.
   (B)   Whenever any vehicle is found to be in violation of the provisions of this section, the owner or driver shall be deemed guilty of such violation, and either the owner or driver may be prosecuted for such violation.
   (C)   (1)   Any person, firm or corporation who is found liable for a violation of division (A)(1) or (2) of this section, or of a violation of § 15-111 (ILCS Ch. 625, Act 5, § 15-111) or 3-401(d) (ILCS Ch. 625, Act 5, § 3-401(d)) of the Illinois Vehicle Code, when written as a local ordinance violation pursuant to § 70.50 of this Code, shall be fined according to the following schedule:

      (2)   For vehicles that are 5,001 or more pounds overweight, the fine shall be computed by assessing $1,500 for the first 5,000 pounds overweight and $150 for each additional increment of 500 pounds overweight or fraction thereof. In the case of violations of division (A)(2) of this section or § 3-401(d) (ILCS Ch. 625, Act 5, § 3-401(d)) of the Illinois Vehicle Code, when written as a local ordinance violation pursuant to § 70.50 of this code, no fine shall exceed the actual cost of the appropriate registration for that vehicle and load as set forth in division (D) of this section.
      (3)   In addition, any person, firm or corporation found liable of four or more violations under § 75.20(A)(1), or of four or more violations of § 15-111 (ILCS Ch. 625, Act 5, § 15-111) of the Illinois Vehicle Code when written as a local ordinance violation pursuant to § 70.50 of this code, within any 12 month period, shall be fined an additional amount of $5,000 for the fourth and each subsequent finding of liability within the 12-month period. With regard to a firm or corporation, a fourth or subsequent finding of liability shall mean a fourth or subsequent finding attributable to any one employee-driver.
   (D)   For any violation of division (A)(2) of this section, or of § 3-401 (d) (ILCS Ch. 625, Act 5, § 3-401(d)) of the Illinois Vehicle Code, when written as a local ordinance violation pursuant to § 70.50 of this code, no fine shall exceed the actual cost of the appropriate registration for that vehicle and load as established below. The following are the registration fees for vehicles and loads:

   (E)   All fines stated in divisions (C) and (D) of this section are exclusive of any fees or costs imposed by State statute and/or county ordinance.
   (F)   All persons charged with a violation under this section, or of a violation of § 15-111 (ILCS Ch. 625, Act 5, § 15-111) or § 3-401(d) (ILCS Ch. 625, Act 5, § 3-401(d)) of the Illinois Vehicle Code, when written as a local ordinance violation pursuant to § 70.50 of this code, shall post a cash bond in an amount equal to the amount of the minimum fine established above, plus fees and costs in the amount currently required by State statute and/or county ordinance. The Defendant may, in lieu of cash bond, deposit a money order issued by a money transfer service company which has been approved by the Finance Department of the Village of Tinley Park. The money order shall be made payable to the Village of Tinley Park.
