After recommendation by the Village Engineer to the Village Board of Trustees, that oversizing of any retention structure is required of an applicant for a permit, then and in that event, the applicant shall be entitled to a recapture of his cost for oversizing to benefit other property. Details of the agreement shall be determined by the President and Board of Trustees based on the recommendation of the Village Engineer and as provided by law.
