§ 34.04 RIGHT OF ENTRY UPON PREVENTING OR EXTINGUISHING FIRES.
   While engaged in preventing or extinguishing fires, any firefighter or other personnel of the Fire Department may enter upon the lands of any person, firm, private or municipal corporation, or the state to carry out his or her duties and while so acting shall not be criminally or civilly liable for entering upon those lands. In no case shall an individual be liable in damages for any injury to the person or property of another caused by him or her while engaged in the performance of his or her official duties, unless the injury results from his or her willful and wanton misconduct.
