505.15 LIMITATIONS ON DANGEROUS AND VICIOUS DOGS.
   (a)    As used in this Section:
      (1)    "Dangerous dog" means a dog that, without provocation, and subject to subsection (a)(3) hereof, has chased or approached in either a menacing fashion or an apparent attitude of attack, or has attempted to bite or otherwise endanger any person, while that dog is off the premises of its owner, keeper, or harborer and not under the reasonable control of its owner, keeper, harborer, or some other responsible person, or not physically restrained or confined.
      (2)    "Vicious dog" means a dog that, without provocation, and subject to subsection (a)(3) hereof, meets any of the following:
         A.   Has killed or caused serious injury to any person;
         B.   Has caused injury, other than killing or serious injury, to any person, or has killed another dog.
         C.   Has attacked and caused serious injury to another dog, domestic animal, or feline on at least two occasions.
      (3)    "Vicious dog" or "Dangerous dog" does not include either of the following:
         A.   A police dog that has killed or caused serious injury to any person or that has caused injury, other than killing or serious injury, to. any person while the police dog is being used to assist one or more law enforcement officers in the performance of their official duties;
         B.   A dog that has killed or caused serious injury to any person while a person was committing or attempting to commit a trespass or other criminal offense on the property of the owner, keeper, or harborer of the dog.
   (b)    No person or organization or corporation, or more than one person, organization, or corporation at a single residence or property location in the City, shall own, keep, harbor or provide sustenance for more than one dangerous or vicious dog, as defined in this section, or any dog of a breed specified in the Ohio Revised Code as a vicious dog.
   (c)    Any person owning, keeping, possessing, harboring, maintaining or having the care, custody or control of a dangerous or vicious dog, or any dog of a breed specified in the Ohio Revised Code as a vicious dog, shall, in addition to the requirements contained in Ohio R.C. 955.22, post a warning sign in a conspicuous place on the premises where the dog is kept. The sign shall be visible and capable of being read from the public highway or street.
   (d)    Any person owning, keeping, possessing, harboring, maintaining or having the care, custody or control of a dangerous or vicious dog, or any dog of a breed specified in the Ohio Revised Code as a vicious dog, shall muzzle and securely confine the dog as described in Ohio R.C. 955.22 when off the owner's premises.
   (e)    Whoever violates this section is guilty of a misdemeanor of the first degree. Each day that a violation of this section exists shall constitute a separate offense.
