165.02  VACATIONS.
   (a)   (a)   All employees of the City, other than the Director of Finance, who are not covered by a union agreement and who work at least thirty hours per week exclusive of lunch periods, sick leave and vacation shall be entitled to vacation with pay based on the following schedule:

   (c)   "Years Completed Service," as used in subsection (a) hereof, except for the Police Chief, Fire Chief, City Engineer, Public Works Superintendent, Park and Recreation Director, and Superintendent, Wastewater and Sewers, includes all full-time employment with the State of Ohio or any political subdivision thereof.  “Years completed service”, as used in subsection (a) hereof for the Police Chief, Fire Chief, City Engineer, Public Works Superintendent, Park and Recreation Director, and  Superintendent, Wastewater and Sewers, includes all full-time employment in a related field of public employment.  Such service need not be continuous.  A part-time employee of the City who becomes a full-time employee with the City will be given longevity credit for purposes of determining vacation from their part-time hiring date, if their employment was continuous until their full-time starting date.

   (d)   Vacation leave to an employee's credit which is in excess of the accrual for the last two years of employment shall be considered excess vacation.  Employees shall forfeit their right to take or to be paid for excess vacation and such excess vacation shall be eliminated from the employee's vacation leave balance on each anniversary of employment.

   (e)   Upon termination of employment regardless of reason, the employee or his estate shall be entitled to compensation at his rate of pay in effect just prior to the effective date of Ordinance Nos. 09-35, 09-37 and 09-38, whichever Ordinance is applicable to his position.

   (f)   Vacation time charged to annual vacation allocation may be taken in increments of one-half hour for up to twenty-one one-half hours of total vacation allocation per calendar year, with no less than forty-eight hours advance notice to the departmental supervisor.  The balance of annual vacation allocation shall be taken in increments of not less than one-half day, with no less than forty-eight hours advance notice to the departmental supervisor.  Upon written request, and for good cause shown, in the judgment of the supervisor, exceptions may be allowed.
