Sec. 8-17.02. Amendments: California Existing Building Code.
   The City Council, after due consideration, finds and determines that the 2022 California Existing Building Code is hereby amended as follows:
   Section 101.2 “Scope” is amended, subsections adopted as published, and is to read as follows:
   [A]101.2 Scope.
   The provisions of this code and Title 8, Chapter 4, the City of Thousand Oaks Code Administration shall apply to the repair, alteration, change of occupancy, addition to and relocation of existing buildings.
   Exception: Detached one- and two-family dwellings and townhouses not more than three stories above grade plane in height with a separate means of egress, and their accessory structures not more than three stories above grade plane in height, shall comply with this code or the California Residential Code.
   101.2.1 Application of Fire Code.
   Where work regulated by this code is also regulated by the construction requirements for existing buildings in Chapter 11 of the California Fire Code, such work shall comply with applicable requirements in both codes.
   Section 103 “Department of Building and Safety” Refer to Title 8 Chapter 1 of the Thousand Oaks Municipal Code, and Chapter 1, Division II, of the 2022 California Building Code for the following topics:
   Powers and Duties of the Building Official, Right of Entry, Stop Orders, Liability, Board of Appeals, Violations, Authority to Disconnect, Permits, Annual Permit, Expiration of Permits, Plan Review, Inspections and Work Exempt from Permits.
   Sections 104, 105, 106, 107 108, 109, 110, 111, 112, 113, 114, 115, 116 and 117 of Chapter I, Division II are hereby deleted.
