(a) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
FIREARM. Any device, by whatever known, which is designed to expel a projectile or projectiles by the action of an explosion, expansion of gas, or escape of gas.
HANDGUN. Any firearm:
(a) Designed or adapted so as to be aimed and fired from one hand, regardless of barrel length;
(b) Any firearm with:
1. A barrel less than 16 inches in length; or
2. An overall length of less than 26 inches.

PERSON. Extends and be applied to associations, clubs, societies, firms, partnerships, bodies (political and corporate), or any group acting as a unit as well as to natural persons.
(B) Special permission, exceptions. It shall be unlawful for any person to discharge any firearm (or) cannon or detonate any explosives any place within the corporate limits of the town, or to assist any other person or persons to engage in any such discharging or detonation, unless such person has been granted special permission by the Town Council, provided, however, this section shall not apply to the following:
(1) Any law enforcement officer who shall so discharge a firearm in the lawful performance of his or her duty;
(2) Any person who shall so discharge a firearm in the lawful protection of life or property when the surrounding facts and circumstances justify such actions;
(3) Any person who shall discharge a firearm during ceremonial occasions, approved by the Town Council;
(4) Members of the U.S. Armed Services or Reserve Forces or State National Guard, while in the performance of their official duties; or
(5) (a) The discharge of an air gun, BB gun, or pellet gun if the weapon is only discharged on private property, utilizing a proper and safe backstop which will prevent any projectile or projectiles from passing through the backstop and beyond the boundary of the private property.
(b) In addition, if the person using and discharging the weapon is a minor, he or she must be under direct supervision of a parent or legal guardian at all times.
(c) This special exception does not grant immunity from any civil or criminal action due to damage and/or injury that might occur due to the improper handling, unsafe discharge, failure to supervise, or any other actions which are inconsistent with this exception.
