§ 70.19 SKATEBOARD REGULATIONS IN DESIGNATED TOWN-OWNED, TOWN PARK BOARD-OWNED AND OPERATED SKATEBOARD FACILITIES.
   (A)   The Town Park Board Commissioners shall establish all rules and regulations addressing the use of skateboards and roller skates in designated town-owned facilities operated by the Town Park Board Commissioners when the same are established.
   (B)   Any person who wishes to skateboard in any designated town or Town Park Board skateboard facility specifically designated for the use of skateboards and/or roller skates shall be required to adhere to all safety requirements and posted rules and regulations.
   (C)   Such regulations shall include, but shall not be limited to, the wearing of protective helmets, kneepads, and elbow pads; rules of conduct for the facility and user fees imposed; proper hours of operation; and penalties. All such regulations shall be conspicuously posted at each town park operated skateboard or roller facility should the same be established by the town or its Town Park Board.
   (D)   Anyone violating the provisions of this section shall be asked to abide by the governing rules and regulations. If the individual refuses to do so, he or she shall be issued a warning notice from the town, shall be asked to leave, and shall not return to that specific designated town-owned skateboard facility for the remainder of that day or shall otherwise remove his or her activity from a town street provided for herein above. Anyone refusing to leave or who returns the same day after having been asked to leave, shall be issued a citation and shall have his or her skateboard and/or skates seized and subsequently impounded by the Town Police Departments.
   (E)   Any confiscated skateboard and/or roller skates, if belonging to a person under the age of 18 years, shall be given up to the parent or guardian of the minor upon request and without charge if a first-time violator, after a full explanation of the reasons for impounding the skateboard and/or roller skates and a copy of the rules of conduct for the usage of skateboards in the town streets in general or for use at a town skateboard facility are given to such parent or guardian.
   (F)   Any confiscated skateboard and/or roller skates, if belonging to a person 18 years of age or older, shall be given to that person upon request and without charge if a first-time violator, after a full explanation of the reason(s) for impounding the skateboard and a copy of the rules of conduct for town skateboard facilities and for operation on the town streets are given to that individual
