(A) Establishment and membership. A Town Park Board is established. The Town Park Board shall be composed of four members appointed by the Thorntown Town Council pursuant to I.C. 36-10-3-4(c). The members shall be appointed on the basis of their interest in and knowledge of parks and recreation. The Thorntown Town Council waives the requirement that a member of the Town Park Board be affiliated with the political party and that not more than two of the four members of the Town Park Board be affiliated with the same political party, which waiver is authorized by I.C. 36-10-3-4.1. Members of the Town Park Board must be residents of the town, pursuant to I.C. 36-10-3-4. The Town Park Board may have one ex officio member who is a member of the governing body of Western Boone School Corporation, as selected by that body pursuant to I.C. 36-10-3-4(c)(l)(A) or a member designated by the governing body of the Western Boone School Corporation, pursuant to I.C. 36-10-3-4(c)(l)(B) and one ex officio member of the governing body of the library district, selected by that body. The ex officio members shall have all the rights of the regular Town Park Board Members, including the right to vote. Members of the Town Council may not serve on the Town Park Board. The members shall serve a four year term. All terms expire on the first Monday in January, but a member continues in office until his or her successor is appointed pursuant to I.C. 36-10-3-5(a). If a vacancy on the Town Park Board occurs, the Town Council shall appoint a person to serve for the remainder of the unexpired term pursuant to I.C. 36-10-3-5(f). A member may be removed only for cause, upon specific written charges filed against him or her. The charges shall be filed with and heard by the Town Council, unless the Town Council is bringing the charges. If the Town Council is bringing the charges, the Town Council shall appoint a hearing officer. The person to hear the charges shall fix the date for the public hearing and give public notice at least ten days in advance of the hearing. At the hearing, the members entitled to present evidence and argument and to be represented by counsel.
(B) Powers. The Town Park Board shall have all the powers as set out in the Park and Recreation Law (I.C. 36-10-3-1 et seq.). Such law is hereby adopted and made a part of this subchapter by reference as it now is, or shall from time to time be amended.
(C) Meetings. All meetings of the Town Park Board are open to the public. The Town Park Board meetings will be held on the fourth Monday of each month at 6:00 p.m. A majority of the members constitutes a quorum. Action of the Town Park Board is not official unless it is authorized by at least three members present and acting. Minutes of the meetings will be kept, recorded, and reported to the Town Council for its monthly meeting on the third Monday of each month.
